These Terms of Sale ("Terms of Sale") govern all services and products offered by Phoenix Jewellers . through the Website. By using the Website, you agree to these and all other applicable terms, including our User Agreement and Privacy Statement, which are hereby incorporated and made a part of these Terms of Sale by this reference. Capitalized terms used but not defined herein shall have the meanings ascribed thereto in the Phoenix Jewellers Inc. Terms and Conditions. Please read these Terms of Sale carefully before placing an order with Phoenix Jewellers Inc.
Product and Service Descriptions
All products and services offered on the Website are offered subject to availability. We try to provide accurate depictions and descriptions of our products and services; however, we do not guarantee that descriptions, colors, dimensions, details, or other content on the Website or in our services are accurate, complete, reliable, current, or error-free. If a product offered on the Website is not as described, your sole remedy is to return it in unused condition (except products that are not eligible for return). Furthermore, colors and other details that you see on your computer may vary from the actual product. We cannot guarantee that your computer will accurately display the details of our products and services.
Phoenix Jewellers ., ITS AFFILIATES AND AGENTS ASSUME NO RESPONSIBILITY FOR ANY DAMAGES OR OTHER CONSEQUENCES DIRECTLY OR INDIRECTLY RELATED TO ANY DECISION. ACTIVITY OR FAILURE TO ACT THAT YOU TAKE BASED ON INFORMATION OR OTHER CONTENT PROVIDED ON ANY OF OUR SITES.
We cannot confirm the price of an item until after you have placed your order. Pricing errors may occur on the Website. We reserve the right to cancel any orders containing pricing errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from us. We may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Pricing for products described or advertised on Phoenix Jewellers Inc. sites may differ from prices in our online store (as well as third party online stores) or through mobile applications. All prices, discounts, and promotions posted on the Website are subject to change without notice.
No Purchases by Minors
The shopping cart and checkout features of the Website are intended to be used by persons who have reached the age of majority (18 in most places), according to the laws where they reside. If a minor orders a product or service through the Website without parent or guardian permission, then the parent or guardian may return the product or service for a refund according to the returns and exchanges policy that relate to the order placed by their child. You must be at least 18-years-old and fully able and competent to purchase services and/or products from us. By placing an order with Phoenix Jewellers Inc. or by clicking on “place order,” you hereby represent and warrant that you are at least 18-years-old and that you are legally able to enter into any and all purchase agreements with us and our partners, vendors, agents, and service providers.
Order Acceptance and Billing
By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item or items ordered. By entering into any transaction on the Website, you represent, warrant and covenant that all information you provide is true, correct, and complete (including, without limitation, your credit card information and billing address); that any credit card transactions submitted by you are authorized; that charges incurred by you will be honored by your credit card company; that you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Website at the time of your order; and that you are the legal holder of any credit card or payment account used to enter into any transaction on the Website.
You must provide truthful and accurate billing information. Providing any untruthful or inaccurate information may result in order cancellation. Before we accept and process an order, we may also request that you provide additional information. We reserve the right to refuse or cancel an order for any reason, including, without limitation, limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified through our efforts to avoid fraud and/or account abuse.
We reserve the right to limit the availability of, and/or to discontinue, any content, product, service, or other feature described or available on our site to any person, entity, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities and/or cancel orders of any content, product, service, or other feature that we provide.
If your order is canceled after your credit card (or another payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. We may request a pre-authorization for some orders placed online with a credit or debit card. This pre-authorization will not be billed to you; however, your card issuer may hold this amount for a short period. Your card issuer determines the length of time the pre-authorization is held. We do this to ensure that the card details are still valid and that you have sufficient funds to complete the transaction.
In order to provide consumers with an enjoyable shopping experience on our site, or for any other reason, we reserve the right to limit quantities available for purchase. Quantity limits may be applied per order, per person or household, or to orders that use the same credit card, billing and/or shipping address, or share any other account or order attribute. We also reserve the right, at our sole discretion, to prohibit sales to dealers or resellers. For our purposes, "reselling" refers to purchasing or intending to purchase any product or products from us for the purpose of engaging in a commercial sale of the same with a third party.
Users who attempt to circumvent quantity limitations (e.g. by using multiple email addresses or accounts to order more than a stated limit or by placing multiple, excessive orders of the same product) may have orders denied and their accounts suspended from further activity. Any individual (based on credit card, email, billing address, or another attribute) who places more than 3 orders within 24 hours of an initial online product release may have those orders placed in our fraud queue for review. We will review orders in our fraud queue and may cancel multiple orders of the same item or items; your account may also be placed on suspension.
Promotional codes are limited in nature, void where prohibited and may expire or discontinue with or without notice. Promotional codes may not be copied, sold, or applied to prior or future purchases. They are not redeemable for cash and are subject to cancellation or change at any time for any reason. Items eligible for promotional discounts may be limited to stock on hand, and rain checks may not be issued or honored.
Returns and Warranties
If you are not satisfied with an item that you have purchased, you may return the item within 30 days of delivery for a full refund of the purchase price, excluding the shipping, handling, gift wrap, and other charges. The item returned must be in unused and unworn condition, in the original packaging (whenever possible), and with all paperwork, parts, and accessories to ensure credit. We do not take title to returned items until we receive them. Items designated as a final sale or non-returnable may not be returned. General Shipping and Processing
Unless otherwise explicitly stated, you are solely responsible for paying all shipping and processing charges relating to your purchases (including any product offered with a service) through the Website. Shipping promotions offered on the Phoenix Jewellers ca. website may not apply to all items and may be subject to other limitations.
Certain bulky or oversized items may include special shipping and handling charges in addition to shipping standard rates. Unless specifically stated on the Website or in other valid offer terms, such special shipping and handling charges will be excluded from shipping promotions, and you will remain responsible for paying them.
All items purchased through the Phoenix Jewellers Inc. website are made pursuant to a shipment contract, which means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Delivery to addresses outside Canada and the U.S.A is not available for all items or to all addresses. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.
You are responsible for paying all sales, use and other taxes, including any applicable duties, relating to any of your purchases of products or services from Phoenix Jewellers Inc. through the Website.

Shipment Processing Time
All orders are generally processed within 2-3 business days, excluding weekends and holidays.
From time to time, we experience a high volume of orders that may result in additional shipping delays up to 5 business days. If you have not received a shipment notification within 5 business days after placing your order, please email us at firstname.lastname@example.org so we can resolve the issue or provide you with a refund.
Shipping Rates and Delivery Times
Shipping charges and delivery time estimates for your order will be calculated and displayed at checkout.
Although we do our best to ensure that orders are shipped as quickly as possible, order volumes and other factors may result in delayed processing times.
Phoenix Jewellers Inc. is not responsible for delivery delays that occur after your shipment has been accepted by a carrier. Please review our General Shipping and Processing terms above for additional information.
Shipments to P.O. Boxes or APO/FPO Addresses
Depending on carrier service availability, shipments to P.O. Boxes or APO/FPO addresses might not be available.
Shipment Confirmation and Order Tracking
You will receive a Shipment Confirmation email and tracking number(s) once your order has been shipped. Please allow up to 24 hours after obtaining a Shipment Confirmation for your tracking number to become active.
Customs, Duties and Taxes
Phoenix Jewellers Inc. is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).
Phoenix Jewellers Inc. is not liable for any products damaged or lost during shipping. Please contact your selected shipment carrier to file a claim for any items that appear to have been damaged during shipping or have not arrived. We recommend that you save all packaging materials and damaged goods before filing a claim with the carrier.
